As this ruling extended the principle of “personhood” to equally corporations and unions, to strive to deny them any proper to operate inside of the legal framework that they had been organized below deprives these “persons” of the freedoms of speech, association and movement. Which means (as soon as yet again, quoting law college educated relatives) that both the courts ought to uphold these rights for that unions (as person “persons” as assured from the Federal (and most state) constitutions, or they've to declare that these attempts at stripping or limiting union rights should apply to leading companies, also.


Marco Arment, the former CTO of the Tumblr blog platform, is best known these days for his time-shifting reading app Instapaper. But he could start a side-job as a financial advisor to start-ups. His motto: Get the money from your customers, not investors.


Arment’s more traditional take is built largely on the idea that if he puts out a good product, there’s no shame in asking customers to pay for it. And the more they pay, the less he needs to rely on outside investors. Arment said many developers are of the mindset that they need to amass a huge number of eyeballs through free services. But they don’t focus enough on building a solid product that can command loyalty and payment from consumers, and instead try to gain profitability through advertising and turning to outside venture capital.


By contrast, Arment says his efforts to monetize Instapaper have been successful because he was able to leverage the hard work he put into his paid versions and the good will he’s gotten back from consumers. And that has allowed him to avoid outside funding, something he plans on doing for the forseeable future.


Don’t Take Funding if You Don’t Need It


“If a service can be profitable and breakeven without VC money, you don’t need to take it,” Arment told me in an interview. “There’s no reason for developers to get a lot of users without charging. There’s another path. My goal is to spread that message: Charge for something and make more than you spend.”


Arment launched Instapaper as a free website in January 2008 and became profitable later that fall when he first began selling a paid iPhone app alongside a free version. He’s been profitable ever since. Arment won’t disclose his revenue, but he said he can cover his expenses and can afford to hire a couple more people if he needed. He left his Tumblr job in September to devote himself to Instapaper.


Though Arment maintains a free iPhone app, he said the focus of the company has been on the paid versions which are updated first (a new update is expected in the next month or so). He has yet to release a free iPad version and has only gotten three emails about the lack of it. Most seem happy to pay for the $5 iPad version. Between 25 and 33 percent of people pay for the $5 paid iPhone version. In fact, as an experiment, he pulled the free iPhone app from the app store for a week a little while back and found that only one person emailed. Sales of the paid version didn’t go up, but they didn’t go down either, he said.


“The free version isn’t really competing as much as I expected with the paid version; a lot of people go straight to the paid version,” he said. “It was only a week but the people who were going to the free version would not have gone to the paid version.”


Let Users Thank You by Paying You


That’s what’s allowed Arment to really focus on the paid segment. In fact, he still questions the value of the free version at times because it can leave a more negative impression for users with its limited set of features. Arment said his paying users have surprised him with their support. He started a $1 a month subscription plan in October that didn’t actually offer much in the way of extra features. It was more of a way to let users show their support for Instapaper. He said the response was overwhelmingly positive.


“That was a huge surprise to me how well it’s doing given there’s no real incentive to do it besides good will. But it ends up that good will is powerful,” Arment said. “It shows that people will pay for something they like because they want to ensure its future.”


Arment is testing the theory again with a new API that leverages his subscription plan. For developers who want to build apps with Instapaper integration, Arment said last month he will require their users to subscribe to Instapaper. Again, the response has been very positive, said Arment. Two hundred developers have applied to get access to the API. All this money-making has allowed Arment to sidestep venture capital money. He has had repeated offers, but Arment said accepting VC funding is akin to taking on a new boss, and the act of raising and maintaining money is a full-time job, he said.


Venture Capital Is Like Having Another Boss


“If you can go without funding, you can be a one- or two-person shop without a whole level of bosses,” he said. “You’re not worried about getting more money and getting diluted anymore.”


Arment’s approach doesn’t work for everyone. He was fortunate to be able to this as a side job and build it up while at Tumblr. And he acknowledges that the lack of funding could be a problem if he wanted to build a staff quickly. But he believes his experience shows that a more old-school approach to building a business and developing a following with consumers is a viable one for entrepreneurs that should be explored more. He may not the biggest company, but he can be a profitable one for a while.


“I don’t need the entire market,” Arment said. “I can get five percent of the market and be rich.”

This was supposed to be an article about monetizing your life as an amateur musician. It’s become an opinion piece on my experience of Google AdSense.


Google Adsense allows you receive revenue through placing content-specific adverts on your website. The system makes Google around $8 Billion a year.


I signed up for Adsense several years ago. I had a travel blog which was general only for family and friends. If I remember correctly, my travel blog made me about £0.05 across 2 years or so.


Fast forward to 2011 and I am trying to investigate means of being a little more business-like about my hobbies (mostly music). By the end of January I had manned up and started to promote my blogs. I had created several different blogs, which were contributed to by friends and colleagues. I promoted these activities through Facebook and Twitter.




After a few weeks, I was looking at around 2,000 hits a month across all my content sources. I was feeling pretty proud of myself. My Google Adsense balance was approaching £10, and I hoped I could make around £50-100 a year. Google then disabled my account.


When your Adsense account is disabled you receive a standard email which tells you there has been "invalid activity". It directs you to a help URL. The only response you can take is to make an appeal.


Taking the matter particularly seriously, I spent some time writing the appeal which outlined my thoughts on the invalid activity. My guess is that I have violated their "don’t click on your own ads" policy when I’ve been proudly showing off my sites to friends and family. Since my IP address is logged on Blogger etc. and my clicks are less than 1% of the total hits received from countries far and wide, I assumed that they would realise my site was genuine.

DailyWorth, the personal finance daily email and community for women, has raised $850,000 in funding led by Robin Hood Ventures with Eric Schmidt’s TomorrowVentures, Howard Lindzon’s Social Leverage, 500 Startups, Venture51, Investors’ Circle, Joanne Wilson, David Cohen, Scott Becker, and Carol Chow participating in the round.


Founded in 2009 by Amanda Steinberg, DailyWorth is a daily email newsletter that includes information on financial literacy and money management skewed towards a female audience. DailyWorth’s subjects range from how to organize your finances to tax tips to saving advice. And DailyWorth has an impressive editorial staff to create content. MP Dunleavey, previously a personal finance columnist with the New York Times and currently a contributor with Money magazine, is leading DailyWorth’s editorial team.


With 55,000 subscribers, the newsletter currently makes money via advertising and already has sponsorships in place with a number of financial institutions including ING and H&R Block. And DailyWorth plans to hold sponsored educational events as an additional revenue channel. The new funding will be used to expand audience reach with customized email newsletters; develop the startup’s website; add video content and to host sponsored events.


DailyWorth is similar in many ways to LearnVest, a personal finance community for women. But DailyWorth is committed to the email newsletter model (which are making a comeback). And there’s definitely room for many personal finance sites oriented towards women.




The media is abuzz with the news that the former head of McKinsey consulting, Goldman Sachs director and current board member of Proctor & Gamble Rajat Gupta has been charged with insider trading by the Securities and Exchange Commission. He is now the highest-profile individual to be implicated in the widespread investigation driven by U.S. Attorney Preet Bharara that has already ensnared dozens of lower-level traders and Raj Rajaratnam, former head of hedge fund Galleon.



The spin has been predictably excoriating, describing Gupta as yet another Wall Street/business titan warped by greed and hubris who is now witnessing his fall. Though he has not been convicted of anything, he has already been found guilty in the press, and it's safe to say that if the day comes when charges are dropped or he is exonerated, that news will not be on the front page of any paper or grace the home page of any web site. Such is the court of public opinion, which has little sympathy for the masters of finance who so recently contributed to a near-meltdown of the very system that made them so rich.



I have no opinion about the guilt or lack thereof of Gupta or Rajaratnam. Like almost everyone save for a handful involved, I don't know what happened and likely never will. But the nature of this investigation should raise the eyebrows even of those who believe that there is something rotten at the heart of American business.



In essence, this investigation and its prosecutions raise the question of whether we are criminalizing behavior simply because it is deemed immoral and allowing prosecutors too much latitude to pry into personal relationships. Both the left and the right are wary of the potential abuses of government investigatory power, and the United States has nurtured a long and powerful tradition of wariness of the claims of officials to be on the side of the angels in pursuing wrong-doing.



Until 2000, when Regulation FD ("fair disclosure") was created by the SEC to curb the trading abuses of the internet bubble of the 1990s where large institutional investors were seen as having an unfair advantage and access to information compared to the masses who bought and sold shares on-line. Reg FD holds that no employee of a publicly traded company could disclose material non-public information on a selective basis. Give it to one person and you had to give to all people, in order to level the investing playing field.



Fair enough in theory, but much stickier in practice. There's a bright line between someone at Intel sharing what the company's sales are to a friend who trades stocks and having a general conversation about how business is going, but a much fuzzier line between having a general conversation over drinks and complaining that senior management doesn't appreciate some new business trend.



There have been many cases of prosecution of individuals who have crossed the bright line, but ensnaring big fish is often harder, so prosecutors become more creative. In the case of Gupta, he made calls to Rajaratnam just after several important meetings of the Goldman Sachs board, and Galleon then made trades of Goldman stock (or options) just after those calls. So it's hard to deny the appearance that information was exchanged.



But just what information? What if Gupta simply said "It went well." Or "it didn't." That might have been sufficient information to trade on, and it certainly was information that the general public didn't have. But is that insider trading according to the definition? Is it disclosure of material non-public information? Are all forms of communication between insiders and outsiders to be criminalized? And if such communication creates some advantages, are advantages born of personal relationships "unfair" to the point where there should be legal action?



In part, all of this is the fallout of a culture looking for villains for the financial crisis. As Charles Ferguson, director of the documentary Inside Job said in accepting his Academy Award, no financial executive has gone to jail for their role in the financial meltdown, and in his view, that is wrong. But is it? Generals routinely mess up during war, either from incompetence, vanity, arrogance or simply the unexpected. They are recalled and sacked, we hope, but unless it can be shown that they willfully and purposely screwed up, they are in our society rarely see a court-martial. Financial executives were culpable in myriad decisions that led to the financial crisis, but that in itself does not translate into prosecution and jail time.



Finally, prosecutors have extraordinary powers in our society, and it is difficult for them to resist the temptation to use the law to enforce public mores. At any given time, some law on the books can be used to police a wide range of behavior. That's great if you agree with the morality that they are enforcing (no abortions, for instance, or no emissions by chemical companies). But it's not so great when that morality is at odds with yours (no abortions, for instance, or no emissions by chemical companies). We live in a system where trials are supposed to afford the accused a chance to clear their name or face penalty, but in a world where reputations are hard to build and easy to lose, prosecutors have undeniable advantages. It is up to them to use that power judiciously.



I have managed money and still do. Stocks today move for all sorts of reasons, are traded globally and electronically often by programs rather than people, and often based on factors having nothing to do with the company per se. Rarely is one data point sufficient. As a result, insider information is neither worth the risk of obtaining it nor usually worth much even if you do. What is perhaps most striking about this case from that perspective is that Galleon is alleged to have made a grand total of $17 million in profit from this inside information. That is a lot of money in the real world, but for Galleon's bottom line, it hardly rates, and certainly would be worth nowhere near the risk of obtaining it by violating Reg FD.



If the charges are true as alleged, then these individuals destroyed careers and their future not for untold riches but for minimal advantage relative to others who did not flirt with the rules. The narrative may say greed, but in truth, the gain wasn't enough for the risk. Galleon reaped hundreds of millions annually by legitimate means, and Gupta supposedly reaped nothing for his insider troubles. We like the simple narratives, but human motives, those are often far more complicated.
